Kristi Anderson Wells co-authored Part 1 of “A Primer on Executive Compensation in a Colorado Divorce,” featured in the May issue of Colorado Lawyer Magazine. This two-part article discusses executive compensation issues in Colorado dissolution of marriage proceedings. Part 1 covers the multistep process for characterizing and dividing executive compensation such as options, restricted stock, restricted stock units, performance-based awards and nonqualified deferred compensation. Part 2, slated for publication in the June 2022 issue of the Colorado Lawyer, addresses limitations on dividing executive compensation awards, looks at tax issues to be aware of when awards are divided, and analyzes whether such awards are income for support purposes.
